A man was sentenced to eight to 14 years imprisonment after he was found guilty of killing a man four years ago in Carcar town, southern Cebu.Regional Trial Court Judge Douglas Marigomen also ordered Benros Campanilla to pay an indemnity of P1.2 million to the family of Danilo Husain. A witness identified Campanilla as the one who shot Husain on April 17, 2004 near the house of the accused in barangay Ocana. Witness Roel Lawas told the court that he was three meters away when he saw Campanilla pull out a gun from his pocket and shoot Husain in the head and the abdomen. A murder charge was filed against the accused but the judge downgraded it to homicide. The judge said Campanilla’s intention in shooting the victim “was not motivated by treachery” but uncontrollable anger when the victim earlier slapped him in the face. About 10 p.m. on April 17, 2004, Danilo and his brother Jack, who was a barangay councilor candidate during that time, were attending a political rally in barangay Ocana. The rally was disrupted when it was stoned. Jack said he saw his brother confront and slap Campanilla, who was tagged as the one behind the stoning. Jack said that he and his brother parted ways during the course of the rally. Jack said that he heard gunfire but did not mind it and decided to go home. Jack said he was later told by Lawas that his brother was shot by Campanilla. Campanilla denied the allegation, claiming that he was in Dalaguete town during the incident. The court, however, dismissed his alibi since there was a witness who positively identified him. |
